1. Acceptance of Terms

By creating an account or using Buddy1AM (the "Service"), operated by Innerly Technologies, you agree to these Terms & Conditions. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old to use Buddy1AM. By using the Service, you confirm you meet this requirement.

3. Nature of the Service

• Buddy1AM offers two independent ways to connect: an AI-based emotional companion, and human peer listeners who you can chat with directly
• These are separate experiences. At present, an AI chat does not automatically redirect or escalate you to a peer listener — if you want to talk to a peer listener, you choose that separately
• The Service is designed for presence and emotional support, particularly during late-night moments — it is not therapy, counselling, psychiatric care, or crisis intervention
• Peer listeners are not licensed mental health professionals unless explicitly stated
• AI responses are generated automatically and may occasionally be inaccurate, repetitive, or not fully appropriate to your situation

4. Safety Layer & Crisis Situations

• Buddy1AM includes an automated safety layer that may detect language suggesting a serious risk to your safety or someone else's, whether in an AI chat or a peer listener chat
• Where such language is detected, we will surface information for licensed crisis helplines so you can connect with trained professional support
• This feature is best-effort and not guaranteed to catch every instance of risk, and it does not constitute emergency response. If you or someone else is in immediate danger, contact local emergency services or a crisis helpline directly, without waiting on the Service

5. Content Standards & Account Bans

• Buddy1AM does not tolerate vulgar, sexually explicit, abusive, or otherwise inappropriate messages directed at peer listeners, or misuse of the AI companion for such purposes
• A first violation will result in a warning alert. Any further violation after that warning will result in immediate and permanent suspension of your account, at our sole discretion
• We reserve the right to skip the warning and ban immediately in serious cases (e.g. threats, harassment of a peer listener, sharing of illegal content)

6. Your Account

• You're responsible for maintaining the confidentiality of your account access (including OTP-based sign-in)
• You agree to provide accurate information and not impersonate another person
• Guest sessions may have limited functionality and data retention

7. Payments, Subscriptions & Refunds

• Access to the AI companion is subscription-based. Your subscription will be billed as described at the time of purchase and will auto-renew unless cancelled before the renewal date
• Peer listener conversations are paid separately, on the basis described at the time of purchase (e.g. per session/credit)
• Cancelling a subscription stops future billing but does not entitle you to a refund for the current billing period
• All payments made on Buddy1AM, whether for AI subscriptions or peer listener sessions, are final and non-refundable, under any circumstances, including partial use, dissatisfaction, or account suspension due to a violation of these Terms
• Prices may change from time to time; we'll notify you of changes affecting an active subscription in advance

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to harass, abuse, or harm another person, including peer listeners
• Attempt to reverse-engineer, scrape, or interfere with the Service or its AI systems
• Share another person's private information without consent
• Use the Service to seek medical, legal, or financial advice in place of a licensed professional

9. Peer Listeners

• Peer listeners are independent individuals onboarded and, where applicable, trained by Buddy1AM, but they are not employees or licensed therapists unless stated
• Access to peer listener conversations is paid, as described in Section 7
• Conversations with peer listeners are for emotional support and companionship, not clinical advice
• Buddy1AM may moderate, review, or restrict access for safety reasons

10. Content You Share

You retain ownership of what you write in chats, journals, or mood check-ins. By using the Service, you grant us a limited licence to store and process this content to provide the Service — including generating AI responses and training/improving our AI companion model over time, with your personally identifying details removed or excluded — as described in our Privacy Policy.

11. Intellectual Property

The Buddy1AM name, branding, design, and underlying software are the property of Innerly Technologies. You may not copy, reproduce, or redistribute them without permission.

12. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that AI or peer listener responses will meet your expectations or needs.

13. Limitation of Liability

To the maximum extent permitted by law, Innerly Technologies and Buddy1AM shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including reliance on AI or peer listener responses in place of professional care.

14. Termination

We may suspend or terminate your access to the Service if you violate these Terms or if we believe it's necessary to protect the safety of our community.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts in [City, State].
